- By purchasing a ticket, each purchaser becomes a member of the Clare GAA Supporters Club from 1st May 2023 to 31st January 2024 inclusive. Each membership shall be entitled to one entry into the raffle, and multiple memberships in the same name are permitted for supporters who wish to buy more than one. Membership of this draw shall be limited to not more than 15,000 members.
- The main prize of the raffle is a four-bedroom house, newly built, in phase 2 of the development known as Derrymore, Tulla Road, Ennis, Co Clare, Ireland. The house commenced construction in early 2023 and is to be completed prior to our draw-date in December 2023.
- Further prizes and bonus prizes may be added during the period of the sales promotion up to and including the final draw date. Details will be as advertised from time-to-time and all members who have purchased prior to any draw date will be included in each draw thereafter.
- The promoter of the draw is the County Committee of Clare GAA under the remit of its’ Management Committee (“ the Organising Committee”). Members of the Organising Committee are excluded from entering the draw.
- The licence to operate the draw was issued by Ennis District Court on 20th July, 2022.
The draw will be held on Monday, January 29th, 2024. The draw may be held on an earlier date at the discretion of the Organising Committee. An extension of up to 30 days later than the above date may also be permitted without cause, but it is intended to have the winner drawn by February 2024 and have the property conveyed to the winner by no later than March 2024.
- The Organising Committee have contracted with Dermot Custy Construction, (“the Builder”) to build the house to a completed finish, including landscaping, roads and services, and internally finished to include fitted kitchen, flooring, painting and tiling, etc.
- The winner accepts that, provided the contractor performs to his contracted obligations, he/she shall have no claims as to the terms of such contract, and accepts that his/her rights are limited to those rights under the building contract, such rights as will be assigned to the winner within 28 days of the draw date.
- The Organising Committee or its agents or promoters shall not in any circumstances be liable for any loss suffered due to any issues or delays in the construction of the house and the winner accepts that once nominated as provided for in condition 8 above, Clare GAA, its Organising Committee or agents shall have no further or other responsibility or liability to the winner save for payment of the full purchase and building contact price.
- The obligations under the contract, including but not limited to the requirement for the owner (winner) to become a member of the management company of the estate, and contribute his/her equitable share of the annual service charges fee, shall become the obligations of the winner on becoming owner of the house.
- The property should have an expected value of €360,000 when completed, based on the current sale price for the Derrymore development phase 2.
- Conveyancing and registration of the property shall be arranged between the solicitor for the Builder and a solicitor to be arranged by and on behalf of the winner. The winner is responsible for his/her own side’s legal fees and any costs of registration of the property, including any stamp-duty or other fees or charges.
- Membership is open to all persons over 18 years of age. Memberships are sold in Ireland, under Irish Law and any regulations in place in Ireland, and provided that they are permitted to do so in their home jurisdiction, memberships can be bought from any location worldwide.
- Memberships cannot be refunded once purchased. However, should the draw not take place for any reason, force-majeure or otherwise, full refunds of memberships will be made within 28 days of draw cancellation.
- Neither the Trustees of Clare GAA, the Officers of the Clare County Committee, nor the members of the Organising Committee, shall be liable in any way to any member/purchaser for any loss suffered in connection with this draw.
- No responsibility can be accepted for entries or payments not received for whatever reason. Purchasers shall receive a confirmation of purchase and a 5-digit ticket-number within 24 hours of purchasing their membership, which confirms their membership and inclusion in the draw. Should any error occur in the processing of payment subsequent to the issuing of the ticket number, the purchaser shall be contacted by e-mail to advise if the transaction has been voided.
- The winner will be contacted by the means of communication they have provided and their identity will be verified within 14 days of the draw date. Their identity and location (town, county or country, as appropriate) shall be publicised on the draw date. The winner agrees to the use of his/her name and images that may be taken at the prize-giving/hand-over, in any publicity material. Any personal data relating to the winner or any other entrants will be used solely in accordance with GDPR and will not be disclosed to a third party without the entrant’s prior consent.
- Clare GAA, the Organising Committee and its agents reserve the right to cancel or amend the competition and these terms and conditions without notice in the event of any unforeseen circumstances or any actual or anticipated breach of any applicable law or regulation or any other event outside of the Organiser’s control.
- Any changes to the rules of the competition will be notified to entrants as soon as possible by or its agents or promoters.
- The operation of the draw and the conduct of the selection of the winning ticket on the draw date shall be independently observed and scrutinised by an independent audit firm. The draw will be held in public and members who have purchased a ticket shall be welcome to attend and observe the draw live. It is also intended that the draw will be streamed live via Facebook Live, Clare GAA TV and/or similar forums.
- By purchasing an entry, the entrant is confirming his/her agreement to be bound by these terms and conditions.
